Welcome to RiseTrail. These Terms & Conditions (“Terms”) govern your use of our website, services, and membership offerings. By accessing or using the RiseTrail website or services, you agree to be bound by these Terms. If you disagree, you must not use the website or our services.

1. Definitions

  • “RiseTrail,” “we,” “our,” “us” refers to RiseTrail, operated under APPe Nik Inc., based in Ottawa, Ontario, Canada.

  • “Website” refers to the RiseTrail website and all related services.

  • “User” or “Member” refers to any individual who accesses, browses, registers for, or otherwise uses the Website.

  • “Services” refers to any programs, membership features, content, or information provided by RiseTrail.

  • “Donations” refers to voluntary contributions made to RiseTrail through cheque or secure online payment.

 

2. Acceptance of Terms

By accessing or using the Website or Services, you acknowledge that you have read, understood, and agreed to these Terms. If you disagree, please discontinue use immediately.

3. Eligibility

Membership is free and open to all individuals across Canada who are capable of entering into legally binding agreements under Canadian law. RiseTrail reserves the right to deny or revoke membership at its discretion for violations of these Terms.

4. Membership & Accounts

  • Membership with RiseTrail is free of charge.

  • Registration may be required to access certain features or resources.

  • Members agree to provide accurate, current, and complete information when registering.

  • Each Member is responsible for maintaining the confidentiality of their login credentials.

5. Donations, Grants & Sponsorship 

  • RiseTrail is supported by donations, grants, and sponsorships.

  • Cash donations are not accepted.

  • Accepted methods of contribution include cheque, sponsorship agreements, or secure online payment.

  • Sponsorships are subject to separate agreements between RiseTrail and the sponsoring organization.

  • All donations and sponsorships are voluntary and non-refundable. 

6. User Conduct

RiseTrail is committed to maintaining a safe, respectful, and inclusive environment. As a condition of using our Services, you agree that you will not:

  • Engage in harassment, hate speech, racism, or discrimination of any kind, including based on race, ethnicity, religion, gender, sexual orientation, or background.

  • Slander, defame, or otherwise make harmful statements against RiseTrail, its mission, its members, or any other individual.

  • Post, share, or transmit unlawful, harmful, threatening, abusive, or offensive content.

  • Interfere with or disrupt the Website, its servers, or networks.

Violation of this section may result in immediate termination of membership and permanent removal from RiseTrail’s services.

7. Intellectual Property

All content on the Website, including text, graphics, logos, images, and software, is the property of RiseTrail or its licensors and is protected by copyright, trademark, and other intellectual property laws. Users may not copy, reproduce, distribute, or exploit any content without prior written consent.

8. Privacy & Data Protection

RiseTrail respects your privacy and protects your personal information in accordance with Canadian privacy laws, including PIPEDA. Please refer to our Privacy Policy for details on how we collect, use, and safeguard your information.

9. Third-Party Services & Links

The Website may contain links to third-party websites or services. RiseTrail is not responsible for the availability, content, or practices of any third-party sites. Use of third-party services (e.g., payment processors, email providers) is subject to their own terms and policies.

10. Disclaimer of Warranties

The Website and Services are provided “as is” and “as available” without warranties of any kind, express or implied. RiseTrail does not guarantee uninterrupted, error-free operation, or the accuracy, reliability, or availability of the Website.

11. Limitation of Liability

To the maximum extent permitted by Canadian law, RiseTrail and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Website or Services.

You agree to indemnify and hold harmless RiseTrail, its officers, employees, and partners from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these Terms or misuse of the Website or Services.

13. Termination

RiseTrail may suspend or terminate your access to the Website or Services at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to RiseTrail, its mission, or its members.

RiseTrail may revise these Terms at any time. Updates will be posted on this page with a new effective date. Continued use of the Website after such changes constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada. Any disputes shall be resolved in the courts of Ontario.

16. Miscellaneous

  • Severability: If any provision of these Terms is found invalid, the remaining provisions remain in effect.

  • Waiver: Failure to enforce any provision shall not be deemed a waiver of that right.

  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the whole agreement between RiseTrail and the User.

  • Assignment: RiseTrail may assign its rights and obligations under these Terms without notice. Users may not assign their rights without prior written consent.
